These terms are the agreement between you and the developer of PokeAlert for your use of the app. By downloading or using PokeAlert you accept them. If you do not accept them, do not use the app.
PokeAlert watches publicly available stock information at retailers and tells you when a sealed trading card product you track comes back in stock. It is an information service. It does not buy anything for you, hold stock for you, or give you any priority with a retailer.
Popular products sell out in minutes, and sometimes in seconds. We do not promise that an alert will reach you in time, that an alert will arrive at all, or that a product shown as in stock will still be available when you open the retailer's page. Stock information comes from the retailers and can be wrong, delayed or withdrawn. Alerts also depend on Apple's push notification service and on your device and network, which are outside our control. Buying a subscription does not change any of this.
PokeAlert is free to install and use. PokeAlert Pro is an optional paid upgrade that delivers alerts instantly rather than after a short delay, and unlocks the retailer and price filters. The features of each tier are described in the app and may change as the app develops.
Use PokeAlert for your own personal collecting. Do not use it to attack, overload or scrape retailers, to resell or redistribute our data, to automate purchasing in breach of a retailer's terms, or to work around the limits of the free tier. Do not attempt to reverse engineer, decompile or interfere with the app or our servers.
PokeAlert is an independent app made for collectors. It is not affiliated with, endorsed by or sponsored by Nintendo, Creatures Inc., GAME FREAK, The Pokémon Company, or any retailer. Product and retailer names are used only to identify the items and stores tracked, and all trademarks belong to their owners. Tapping a product opens the retailer's own page; what happens there is between you and that retailer, under their terms.
We may change, suspend or discontinue any part of the app, including which retailers and regions are covered, and we may update these terms. Continued use after a change means you accept the updated terms. If we stop the service entirely while you hold an active subscription, you may seek a refund for the unused part through Apple.
The app is provided "as is", without warranties of any kind to the extent the law allows. We are not liable for a product you missed, a purchase you did not make, a price you paid at a retailer, or any indirect or consequential loss. Nothing here limits liability that cannot be limited by law. To the extent permitted, our total liability is limited to the amount you paid us for the app in the twelve months before the claim.
Apple is not a party to these terms and has no obligation to provide support for the app. Apple is a third-party beneficiary of these terms and may enforce them against you.
